授業の目的・内容 /Course Objectives |
知的財産権法の基礎理論に関する英語文献を輪読する。Peter S. Menell, Mark A. Lemley, Robert P. MergesのIntellectual Property In The New Technological Age 2018: Vol. I : Perspectives, Trade Secrets, Patents (Clause 8 Publishing, 2018)を取り上げ、特に営業秘密・特許・意匠に焦点を当てて全員で講読する。受講は発表を担当してもらうことを予定している)。そのうえで日本法における営業秘密・特許・意匠の法理論と比較しつつ、教員と受講者または受講者同士で質疑応答を行い、理解を深める。 | ||||||||||
