授業の目的・内容 ／Course Objectives	Objectives The course is designed to research the legal system of private international law on the tort of each country with the graduates. Curriculum      The program consists of two components which are not divisible.  Each student is required to attend at all of three courses in the following subjects: Course 1 Private International Jurisdiction Matters                                    Course 2 Applicable Law in Tort
授業の形式・方法と履修上の注意 ／Teaching method and Attention the course	Remarks There will be a mandatory informational meeting in the first week of the spring course for all those who wants to take the course.
事前・事後学修の内容 ／Before After Study	事前学修：該当箇所の文献を良く調査しておいて下さい。 事後学修：講義中に扱った事項に関する問題点に関して、十分に考察して下さい。

評価方法 ／Evaluation	Examination (Evaluation) Students are required to submit a term paper at the end of each term. 課題への取り組み姿勢と成果60％　レポート40％の割合で評価する。

1	Course I   Jurisdiction in Tort	我が国の不法行為の国際裁判管轄に関する規範を概観します。
2	General Matters	不法行為の国際裁判管轄について一般的な問題を検討します。
3	Jurisdictions	各不法行為の類型毎に問題の所在を検討します。
4	Burdens and Relative Standards of Proof	管轄原因事実の挙証責任と求められる証明度について検討します。
5	Restraint of Foreign Proceedings	外国訴訟差し止めの方法とその是非について検討します。
6	Foreign Jurisdiction Agreements	外国での訴訟を合意することの可否を検討します。
7	Assumed Jurisdiction	合意された法廷地と本来の法廷地との乖離について検討します。
8	Jurisdiction Clauses	管轄合意の要件と方式について検討します。
9	Plaintiff Applies to Stay	原告からする訴訟手続の中止について検討します。
10	Conclusions	これまでの議論を踏まえて、不法行為の国際裁判管轄について再考察します。
